Focusing on the problem of disputed stagnation expenses, FMC has appointed a specialist Rebecca F. Dye to conduct investigations, and released the final investigation report (Fact Finding 28) in May 2020, which aims to be the carrier (VOCC), no shipless ship, no shipless ship, no boat without boat ships, no boats, no boats, no boats. The day time allows the other party to make objections and provide clear information about how to resolve disputes.
Specifically, FMC put forward four requirements:
1. The invoice provided by the carrier must include the information list specified in OSRA 2022 46 U.S.C.c.c.c. 41104 (d) (2);
2. In the D & D invoice list, additional information must be added;
3. Further define the prohibited approach, clarify which parties may be asked to collect D & D;
4. Establish an invoicing practice that the invoicer must follow when issuing a D & D invoice.
FMC recommends that only invoices to companies that sign a cargo transportation contract or warehousing contract with the invoicer. At the same time, FMC stated that it was particularly interested in whether the consignee on the bill of lading (The Consignee) was suitable as an involuntary object.
The proposed rule formulation notice is the new measure of the FMC implementation of OSRA 2022. Once the rule is announced in the Federal Communist Party, the parties will submit opinions for 60 days.
