Announcement on the import and export of hazardous chemicals and the inspection and supervision of their packaging

According to the Regulations on the Safety Administration of Hazardous Chemicals (Order No. 591 of The State Council), the Customs is responsible for the inspection of the import and export of hazardous chemicals and their packaging. Notice on the relevant issues is as follows:
 
1. The Customs shall inspect the import and export of hazardous chemicals listed in the National Catalogue of Hazardous Chemicals (latest version).
 
When the consignee or its agent of the import of hazardous chemicals declares customs, the declaration shall include the category of danger, the category of packaging (except bulk products), the United Nations dangerous goods number (UN number), the United Nations dangerous goods packaging mark (packaging UN mark)(except bulk products), etc., and shall also provide the following materials:
 
(a) the Declaration of Conformity of Imported Hazardous Chemicals Enterprises (see Annex 1 for the style);
 
(b) For the products that need to add inhibitors or stabilizers, the name and quantity of the actual added inhibitors or stabilizers should be provided;
 
(3) Chinese hazard publicity label (except for bulk products, the same below), Chinese safety data sheet samples.
 
The consignor or his agent for the export of hazardous chemicals shall provide the following materials when applying to the Customs for inspection:
 
(a) the Export of hazardous chemicals production enterprises Compliance Declaration (see Annex 2 for the style);
 
(2) The Inspection Result of the Performance of the Packaging of Outbound Goods (except bulk products and those exempted from the use of dangerous goods packaging by international regulations);
 
(3) classification and identification report of dangerous characteristics;
 
(4) Danger publicity label (except bulk products, the same below), safety data samples, if foreign samples, the corresponding Chinese translation should be provided;
 
(e) For the products that need to add inhibitors or stabilizers, the name and quantity of the actual added inhibitors or stabilizers should be provided.
 
4. Hazardous chemicals import and export enterprises shall ensure that hazardous chemicals meet the following requirements:
 
(1) the mandatory requirements of China's national technical specifications (applicable to imported products);
 
(2) Relevant international conventions, rules, treaties, agreements, protocols, memoranda, etc.;
 
(3) Technical regulations and standards of the importing country or region (applicable to export products);
 
(4) Technical specifications and standards designated by the General Administration of Customs and the former General Administration of Quality Supervision, Inspection and Quarantine.
 
5. The contents of the inspection of import and export hazardous chemicals include:
 
(A) the main ingredients/components of the product information, physical and chemical characteristics, danger categories, etc. comply with the provisions of Article 4 of this announcement.
 
(2) Whether there is a hazard publicity label on the product packaging (imported products should have a Chinese hazard publicity label), whether it is accompanied by a safety data sheet (imported products should have a Chinese safety data sheet); Whether the contents of the hazard publicity label and safety data sheet comply with the provisions of Article 4 of this announcement.
 
6. For the packaging used for imported hazardous chemicals, the packaging type, packaging mark, packaging category, packaging specifications, weight of a single piece, and use status of the package shall be inspected for compliance with the provisions of Article 4 of this Announcement.
 
7. For the packaging of export hazardous chemicals, performance inspection and use appraisal shall be carried out in accordance with the regulations and standards on the inspection and administration of packaging of export dangerous goods for sea transport, air transport, road transport and railway transport, and the Results of Performance Inspection of Packaging for Export Dangerous Goods and the Results of Use Appraisal of Packaging for Export Dangerous Goods shall be issued respectively.
 
8. The import and export of hazardous chemicals used as food and food additives shall comply with the relevant provisions of food safety.
 
9. This announcement shall come into effect on January 10, 2021, and the former Announcement No. 30 of 2012 of AQSIQ shall be repealed at the same time.
